What is the process to get a divorce?
Starts with filing the petition and serving the petition on the other side by personal service at which point the respondent has 30 days within which to file a response.
How long does it take to get a divorce (in the State of California)?
A divorce can be final no sooner than 6 months and 1 day after service upon the respondent but it can take longer than that depending on several factors.
Do I give up any rights if I move out of the house?
Moving out of the house generally does not give up any rights that you may have. Although, each case is specific unto itself.
If I bought a house with my spouse and used my separate property for the down payment, do I get it back?
Under California Family Code Section 2640, spouses are entitled to be reimbursed for their separate property contributions to the acquisition of property.

Do I need fault to get a divorce?
In California, you do not need to prove fault to acquire a divorce. The only grounds necessary are “irreconcilable differences.”
How do I conclude my case?
Approximately 90% of all cases settle and the rest are tried by the court. Sometimes it is less expensive to go to court than to engage in endless and fruitless settlement negotiations.
